Warranty and Replacement Policy for Wireless Hardware Installations
1. Scope: This Warranty and Replacement Policy (the "Policy") applies to all wireless hardware products (the "Products") sold by MikroTikSA Networks CC (hereafter referred to as MikroTikSA).
2. Definitions: For the purposes of this Policy, the following definitions apply:
a. "Product" means any wireless hardware product sold by MikroTikSA.
b. "Warranty Period" means the period of time during which the Product is covered under warranty, as determined by MikroTikSA.
c. "Limited Warranty" means the limited warranty provided by MikroTikSA for the Product, as set forth in this Policy.
d. "Hardware" means any wireless hardware product sold by MikroTikSA.
e. "Installation" means the process of installing the Hardware at the location specified by you (the "Location").
f. "Location" means the physical location where the Hardware will be installed, which may include a residence, office building, or other structure.
3. Limited Product Warranty: MikroTikSA warrants that the Product will be free from defects in materials and workmanship for a period of 12 months from the date of purchase (the "Warranty Period"), unless otherwise stipulated by the manufacturer. During the Warranty Period, MikroTikSA will repair or replace any defective Product returned to MikroTikSA in accordance with this Policy. In the cases where the Warranty Period is not 12 months, it will be stipulated at the time of purchase.
4. Limited Installation Warranty: MikroTikSA warrantees all installations for a period of 3 months fromdate of installation. During this period any repairs, excluding the conditions listed in point 5 below, will be undertaken at MikroTikSA’s cost. Beyond 3 months, the hardware will still be covered under the manufacturer’s warranty, however there may be a call-out fee charged for replacing the faulty unit.
5. Exclusions: The Limited Warranty does not cover any of the following:
a. Damage caused by misuse, abuse, or neglect.
b. Damage caused by exposure to excessive temperatures, humidity, or other environmental factors such as lightning or severe weather.
c. Damage caused by accident, misfortune, or unforeseen events.
d. Any defects or issues that arise after the Warranty Period has expired.
6. Installation Requirements: You must provide a clear and level surface at the Location for the installation of the Hardware.
a. MikroTikSA will not be responsible for any damage caused by improper installation, including but not limited to damage caused by uneven or unstable surfaces.
b. MikroTikSA will endeavour to use the appropriate mounting hardware after inspection of the mounting surface. This may or may not include wall brackets, mounting bolts, chemical anchors, outdoor data cabling, trunking, PVC tube, wall boxes, cable ties, cable clamps and other hardware generally used in the installation of outdoor fixed wireless equipment.
c. While we will try to determine as accurately as possible the correct mounting hardware to use, it is acknowledged that it is not always possible to determine issues or weaknesses in the underlying substrate. MikroTikSA will not be responsible for any damage caused by failure of the underlying substrate to properly support the mounting hardware.
7. Equipment Settings: MikroTikSA will setup the software as required for the clients' purposes. Generally, MikroTikSA does not permit Client access to devices that MikroTikSA manages. If client access is requested, a waiver must be signed by the Client acknowledging that any setting changes that cause disruption of service will be repaired at the Client’s cost.
8. Data Security: You are responsible for ensuring the security of any data transmitted or stored through the Hardware. MikroTikSA will not be responsible for any data breaches or other security issues resulting from improper use of the Hardware and any associated Software.
9. Maintenance: You are responsible for maintaining the Hardware in good working condition, including but not limited to regularly checking the mounting location and alerting MikroTikSA to any obvious signs of damage.
10. Replacement: To initiate a warranty claim, you must contact MikroTikSA through the standard communication channels. If the Product is found to be eligible, MikroTikSA will provide a replacement Product of equal value.
11. Limitation of Liability: MIKROTIKSA'S LIABILITY FOR ANY REASON UNDER THIS POLICY SHALL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCT BY YOU. IN NO EVENT SHALL MIKROTIKSA BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES.
12. Governing Law: This Policy shall be governed by and construed in accordance with the laws of South Africa.
13. Entire Agreement: This Policy constitutes the entire agreement between you and MikroTikSA regarding the warranty and replacement of the Product.
14. Changes to Policy: MikroTikSA reserves the right to modify this Policy at any time without notice.
